EB-5 Visa: Invest Your Way to a U.S. Green Card

The EB-5 visa, also known as the Immigrant Investor Program, is a unique opportunity for foreign investors to secure permanent residency (green card) in the United States by investing a significant amount of capital into a U.S. business. This program plays a vital role in uplifting the U.S. economy by attracting foreign investment and creating jobs.

What is an EB-5 Visa?

The EB-5 visa allows foreign nationals who invest in a qualified U.S. commercial enterprise to obtain a green card for themselves and their immediate family members. It provides a wealth creation opportunity alongside the chance to live, work, and invest freely in the U.S. It requires an investment of $1.8 million (or $900,000 in targeted employment areas)

Ways to Qualify for EB-5 visa

Direct Investment

Investing a minimum of $1,050,000 in a new commercial enterprise located in a TEA (Targeted Employment Area), which is a rural area or an area with high unemployment.

Investment Through a Regional Center

Investing a minimum of $800,000 in a USCIS-approved regional center project. These projects are pre-approved by USCIS to create jobs and promote economic growth.

As of March 15, 2022, the EB-5 Reform and Integrity Act implemented new requirements and a sunset provision for the Regional Center Program expiring on September 30, 2027

EB-5 Visa process

The EB-5 visa application process generally involves several steps:

  • Investment in a Qualified Project: Identify and invest in a USCIS-approved EB-5 project that meets the minimum investment amount requirement.
  • 526 Petition: File Form I-526, Immigrant Petition by Alien Entrepreneur, with USCIS. This petition demonstrates your investment and the job creation potential of the project
  • Conditional Green Card: Upon I-526 approval, you and your family receive a conditional green card valid for two years.
  • 829 Petition: After two years, you must file Form I-829, Petition to Remove Conditions on Permanent Residence, to prove your investment remains at risk and the required jobs have been created
  • Permanent Green Card: If I-829 is approved, your conditional green card is removed, and you receive a permanent green card

Requirements for EB-5 Visa and Documents Needed

The specific requirements and documents needed for an EB-5 visa application will vary depending on the investment type. However, some general requirements include:

  • Proof of lawful source of investment funds
  • Business plan for the investment project (if direct investment)
